These Terms of Use ("Terms") govern your use of the SwipeHelperAI mobile application and related services ("App" or "Service"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Description of the service
SwipeHelperAI provides AI-powered tools to generate and edit photos for personal use (including for dating profiles) and to provide dating conversation advice ("Rizz Help"). You upload photos and prompts and may provide conversation text; we use third-party AI services (including fal.ai for image generation and Fireworks AI for text advice) to generate results. The App may offer subscriptions, in-app purchases of credits, and other features as described in the App and on our website.
2. Eligibility
You must be at least 13 years of age (or the minimum age in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement and have the legal capacity to enter into these Terms.
3. Acceptable use
You agree to use the App only for lawful purposes and in accordance with these Terms. You must not:
- Use the App to create, upload, or share content that is illegal, harmful, abusive, defamatory, infringing, or that violates others' rights or dignity.
- Upload photos of other people without their consent for the purpose of generating images that could mislead or harm them.
- Use the App to generate content that exploits or endangers minors.
- Attempt to reverse engineer, hack, or disrupt the App, our systems, or our providers (including fal.ai).
- Resell, redistribute, or commercially exploit the Service or generated content in a way that violates these Terms or applicable law.
We may suspend or terminate your access if we reasonably believe you have violated these Terms or applicable law.
4. Your content, generated images, and advice
You retain ownership of the photos you upload and the conversation text you provide. You grant us and our service providers (including fal.ai for image generation and Fireworks AI for text advice) the rights necessary to process your uploads and inputs and generate images and advice (e.g., transmit, store temporarily, and use as inputs to the AI). Generated images and advice are provided for your personal use. You are responsible for how you use generated images and advice and for ensuring that your use complies with law and platform rules (e.g., dating app or social media policies).
5. Subscriptions and purchases
Subscriptions and in-app purchases (including credits) are processed by Apple. Payment terms, renewals, cancellations, and refunds are governed by Apple's terms and your Apple account. We do not guarantee refunds; any refund requests should be directed to Apple where applicable.
6. Disclaimers
The App and generated content are provided "as is." We do not guarantee that generated images will meet your expectations or be suitable for any particular use. AI-generated content may be inaccurate or inappropriate; you are responsible for reviewing and using it appropriately. We are not liable for any decisions or actions you take based on the App or generated content.
7. Limitation of liability
To the maximum extent permitted by law, we (and our affiliates, providers, and partners) are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, or profits, arising from your use of the App or these Terms. Our total liability for any claims related to the App or these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or one hundred U.S. dollars if greater).
8. Indemnification
You agree to indemnify and hold harmless SwipeHelperAI and its affiliates, officers, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the App, your content, your violation of these Terms, or your violation of any third-party rights or law.
9. Third-party services
The App relies on third-party services (including Apple for distribution and payments, fal.ai for AI image generation, and Fireworks AI for AI text advice). Your use of those services may be subject to their respective terms and policies. We are not responsible for the availability, performance, or policies of third-party services.
10. Changes to the service and terms
We may modify the App or these Terms at any time. We will post updated Terms on this page and update the "Last updated" date. Material changes may be communicated in the App or by email where appropriate. Continued use of the App after changes constitutes acceptance of the updated Terms.
11. General
These Terms constitute the entire agreement between you and SwipeHelperAI regarding the App. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These Terms are governed by the laws of the United States (and the State of California to the extent applicable), without regard to conflict of laws principles.
